Summary

The landscape of personal injury settlements has changed dramatically as Medicare Secondary Payer (MSP) compliance, conditional payment reimbursement obligations, Medicare Advantage claims, LMSAs, Section 111 reporting, and future medical exposure continue to reshape settlement negotiations nationwide. Plaintiff attorneys are increasingly facing release language requiring them to personally indemnify defendants, carriers, and third parties against unresolved Medicare or reimbursement claims long after settlement funds are distributed.

John Cattie will examine the growing ethical and legal concerns surrounding attorney indemnification provisions in personal injury settlements and the emerging national trend among state ethics authorities rejecting personal guaranties by plaintiff counsel. Attendees will gain practical insight into how MSP obligations intersect with professional responsibility rules, future Medicare interests, settlement administration, and evolving liability exposure.

The program will also explore the distinction between legitimate MSP compliance and improper attempts to shift speculative future Medicare liability onto plaintiff attorneys personally, while providing practical strategies for negotiating settlement language, protecting clients, and reducing downstream compliance risks.
